State & Federal Drug Offenses
Drug crimes are among the most common offenses prosecuted in the state of Mississippi. A wide range of offenses exist under state law that are associated with controlled substances such as marijuana, cocaine, methamphetamine, other street drugs, and fraudulently obtained prescription painkillers such as opioids.
Mississippi drug crimes include:
- Possession with intent to distribute - Being caught with more than what would be considered for personal usage. For most controlled substances, this is 30 grams.
- Possession of drug paraphernalia - Possessing drug paraphernalia that is intended for creating (manufacturing or growing) a controlled substance or for consuming a controlled substance
- Drug cultivation and manufacturing - Manufacture, grow, or possess materials to be used to grow or manufacture a controlled substance.
- Drug Distribution - Illegally deliver or distribute a controlled substance.
- Drug trafficking - Selling or distributing a controlled substance over a certain amount depending on what substance it is. (30 grams for heroin, methamphetamine and cocaine)
- Conspiracy - When 2 or more people agree to commit a drug crime.
Along with stiff fines, penalties can range from incarceration for months to years depending on which drugs were involved, their quantity, and other relevant factors.
Federal drug offenses like those above are often investigated on a larger scale by such agencies as the DEA and FBI leading to aggressive action by federal prosecutors. Convictions of federal drug crimes are also subject to mandatory minimum sentences that can be harsher than state penalties.
Mississippi Drug Trafficking Laws and Penalties
According to Mississippi Code Title 41. Public Health ยง 41-29-139, the transfer and/or possession with intent to transfer controlled substances is punishable by felony charges.
A person convicted of such charges is subject to:
- Imprisonment between 10 and 40 years
- Fines between five-thousand dollars ($5,000) and one-million dollars ($1,000,000)
Prison time and actual fine amount is based on what class and amount of drugs is being trafficked or in possession with the intent to transfer.
